What is the Multistate Environmental Response Trust (Multistate Trust)?

The Multistate Trust is a private, independent environmental response trust created as part of the 2011 Tronox bankruptcy settlement. Appointed by the United States Bankruptcy Court for the Southern District of New York, the Multistate Trust is responsible for owning, investigating, cleaning up, and facilitating the reuse of hundreds of former Kerr-McGee/Tronox sites, under the oversight of the beneficiaries for each site.

Who currently owns the former Kerr-McGee sites that are now the responsibility of the Multistate Trust?

Greenfield Environmental Multistate Trust LLC, trustee of the Multistate Environmental Response Trust, owns the sites.

How does the Multistate Trust clean up its sites?

To accomplish its purposes and to protect human health and the environment, the Multistate Trust closely collaborates with its beneficiaries to clean up its sites in compliance with all laws, regulations and best practices, and in accordance with lead regulatory agency-approved permits and cleanup plans.

How will Kerr-McGee sites be reused after cleanup?

If the future use of a site has not yet been decided, the Multistate Trust will try to work with interested community members and other stakeholders to identify safe, beneficial, potential future reuse(s) for each site. Transfer or sale of a site or any portion of it must be approved by the governmental beneficiaries for each site. Cleanup actions proposed by the Multistate Trust for a site will take into consideration a range of potential future reuses.

Who receives the proceeds once a former Kerr-McGee property is sold?

The proceeds from any site sale would be used to fund additional cleanup activities at or near the site. If there are no further cleanup activities needed at or near the site, the proceeds would go to fund cleanups at other former Kerr-McGee/Tronox sites now owned by the Multistate Trust.

Can I receive compensation related to the contamination at a former Kerr-McGee Site?

The Tronox Tort Claims Trust (Tort Trust) was established by the United States Bankruptcy Court for the Southern District of New York to receive and process claims against Tronox for personal injury (health or medical) or property damage.

The Multistate Trust is not affiliated with or related to the Tort Trust, and cannot accept, process, or pay personal injury or property damage claims.
